Democratic Congressman Bennie Thompson filed a lawsuit against Donald Trump and Rudy Giuliani on Tuesday.

Let's have trial by combat, accusing the two Republicans of conspiring with the far right groups, proud boys and oath keepers to incite last month's deadly riot at the U.

S Capitol, the first civil action filed against the former president since the attack.

Thompson, who chairs the House Homeland Security Committee, is the named plaintiff on the suit, which is backed by the NAACP.

The civil lawsuit accuses Trump and Giuliani of violating the Ku Klux Klan Act, a post Civil War law that allows lawsuits to be brought against government officials over claims they conspired to violate civil rights.

The press release announcing the lawsuit said quote the insurrection was the result of a carefully orchestrated plan by Trump, Giuliani and extremist groups like the Oath Keepers and Proud Boys, all of whom shared a common goal of employing intimidation, harassment and threats to stop the certification of the Electoral College.

Other members of Congress are expected to join the lawsuit.

It seeks compensatory and punitive damages without citing a dollar figure, and it asks a federal judge to issue an order barring Trump and his co defendants from future violations of the law.

Trump advisor Jason Miller dismissed the allegations in the lawsuit setting Trump's acquittal in the Senate impeachment trial.

Most Republicans voted against convicting Trump, but Senate Minority Leader Mitch McConnell made it clear he still felt Trump was responsible and that he could still face legal consequences.

President Trump is still liable for everything he did while he was in office.

 Trump also faces a criminal investigation into his attempts to influence Georgia's election outcome after he was recorded in a January 2nd phone call trying to pressure a top state official to overturn the state's election results based on unfounded claims of voter fraud.
